Government of India in the year 2008 and 2009 announced numerous stimulus packages to salvage not only banks but also the Indian economy as a whole from crisis erupted in foreign countries. Unfortunately after lapse of three years and huge stimulus packages the country is facing the same crisis as it faced in the year 2008 and before.
It is astonishing and mysterious too that public sector banks in general used to offer higher and higher rate of Interest to attract corporate deposit , bulk deposit and government deposit in their fold upto 2010 and on the contrary they were ready to finance at sub BPLR rate to corporate . Banks were booking higher and higher profit before 2008 and upto 2010 and showing lower and lower Net NPA and Gross NPA inspite of offering higher deposit rates and lower lending rates.
But during last one year or so when RBI has resorted to rate hikes 12 times and when banks are forced to accept base rate to avoid sub PLR lending, almost all banks have raised BPLR and Base rate to their peak level and on the contrary they have stopped almost completely offering higher rate of interest on deposits to corporate, government departments and cash rich PSUs.. Surprising during last four quarters, profit of most of the banks have either come down or started falling quarter after quarter despite the fact that lending rate is increased abnormally and deposit rate increase is stopped and controlled to a great extent.
What mystery and magic lies behind this is beyond my comprehension, but I am very much confident that the dirty game of bankers will be exposed only when thorough investigation is carried out and some of CMDs and EDs and some of CAs are booked to task who are carrying out fraudulent activities just similar to what Raju carried out in Satyam Computers.

After complete introduction of Core Banking Solution (CBS) in banks, Reserve bank of India advised banks to calculate bad assets called as Non Performing assets (NPA) on common terminology using advanced technology and not manually . Banks are slowing getting pressure to assess their quality of assets through automated system taking advantage of CBS technology. Since management of banks find now difficult to conceal bad assets under CBS oriented NPA assessment system, total of bad assets is now being exposed in Balance sheet and it has reached a level of 3% of total advances.
It is to be noted here that NPA percentage is still more than what it has been revealed during last few quarters. Still banks have not declared their entire NPA and after taking RBI hidden consent. Of course they are gradually exposing their bad assets and this is why quantum of bad assets has not jumped to highest position in one time but it is rising quarter after quarter. Officials of RBI, top management of each PSB and official of Ministry of Finance all know very well that actual quantum of bad assets in government banks is far more than 5% of total advances. In more than 25% of three year old branches gross NPA is more than 25% of total advances. There are many such branches where gross NPA is even more than 50% of total advances.
Clever bank management are trying their best to show minimum percentage of gross NPA by either manipulating the system secretly or by resorting to fresh lending by opening new branches and resorting to fresh bulk lending to big corporate, to real estate sector and to mutual funds so that total advances in banks increases which in turn reduces percentage of Gross NPA compared to Total Advances. But this story will not help for longer period until there is adequate improvement in quality and moral integrity of credit sanctioning authority , honesty in promotion processes in banks ,improvement in legal machineries which may help in recovery from willful defaulters , tightening of screws on Chartered Accountants , Valuers and official of rating agencies and change in attitude of politicians. Bank management has to increase number of staff in branches, reduce staff at administrative offices and award honest officers by stopping and punishing corrupt officers who were rising in their career through unfair ways and means. Till now bank management has not tried to cure the real disease and at the same time government of India have also not improved the quality of legal system and not tried to inculcate good culture in politicians who are using bank loan to enhance their personal wealth and to increase their vote banks.
It is very sad that all the time when proportion of bad assets increases in banks , management of banks accuse global recession, interest rate hike, bad monsoon, natural calamities etc but not punish the real culprit. It is remarkable here that when most of top official have occupied the top post and come through bad routes and when they have themselves created and accumulated bad assets in their banks they are not in a position to punish the real culprit and hence they are searching always some weak scapegoat , some lame excuses and pleading some irrelevant reasons before MOF for deteriorating quality of bad assets in banks.
Million dollar questions is “Who will bell the cat when even officials in RBI and MOF are equally weak and guilty”. System is not corrupt but corruption has become the system in banks. Not only banks but all other government departments including judiciary are also victim of same disease.
It is therefore not surprising that public demand led by Anna for strong Lokpal Bill is gaining momentum month after month, day after day and none can stop this. Government can torture Anna, Ramdeo and their followers but cannot stop public revolt without punishing corrupt officials and corrupt politicians.

Why Government Lokpal Bill is fraud
Critique of Government’s Lokpal Bill 2010
(Proposed to be passed as an ordinance by the Central government)
UPA government has been under constant attack due to exposure of one scam after the other on the issue of corruption. In order to salvage its image, the government proposes to set up an institution of Lokpal to check corruption at high places. However the remedy seems to be worse than the disease. Rather than strengthening anti corruption systems, this bill if passed, will end up weakening whatever exists in the name of anti corruption today.
The principal objections to government’s proposal are as follows:
Lokpal will not have any power to either initiate action suo motu in any case or even receive complaints of corruption from general public. The general public will make complaints to the speaker of Lok Sabha or chairperson of Rajya Sabha. Only those complaints forwarded by Speaker of Lok Sabha/ Chairperson of Rajya Sabha to Lokpal would be investigated by Lokpal. This not only severely restricts the functioning of Lokpal, it also provides a tool in the hands of the ruling party to have only those cases referred to Lokpal which pertain to political opponents (since speaker is always from the ruling party). It will also provide a tool in the hands of the ruling party to protect its own politicians.
Lokpal has been proposed to be an advisory body. Lokpal, after enquiry in any case, will forward its report to the competent authority. The competent authority will have final powers to decide whether to take action on Lokpal’s report or not. In the case of cabinet ministers, the competent authority is Prime Minister. In the case of PM and MPs the competent authority is Lok Sabha or Rajya Sabha, as the case may be. In the coalition era when the government of the day depends upon the support of its political partners, it will be impossible for the PM to act against any of his cabinet ministers on the basis of Lokpal’s report. For instance, if there were such a Lokpal today and if Lokpal made a recommendation to the PM to prosecute A. Raja, obviously the PM will not have the political courage to initiate prosecution against A. Raja. Likewise, if Lokpal made a report against the PM or any MP of the ruling party, will the house ever pass a resolution to prosecute the PM or the ruling party MP? Obviously, they will never do that.
The bill is legally unsound. Lokpal has not been given police powers. Therefore Lokpal cannot register an FIR. Therefore all the enquiries conducted by Lokpal will tantamount to “preliminary enquiries”. Even if the report of Lokpal is accepted, who will file the chargesheet in the court? Who will initiate prosecution? Who will appoint the prosecution lawyer? The entire bill is silent on that.
The bill does not say what will be the role of CBI after this bill. Can CBI and Lokpal investigate the same case or CBI will lose its powers to investigate politicians? If the latter is true, then this bill is meant to completely insulate politicians from any investigations whatsoever which are possible today through CBI.
There is a strong punishment for “frivolous” complaints. If any complaint is found to be false and frivolous, Lokpal will have the power to send the complainant to jail through summary trial but if the complaint were found to be true, the Lokpal will not have the power to send the corrupt politicians to jail! So the bill appears to be meant to browbeat, threaten and discourage those fighting against corruption.
Lokpal will have jurisdiction only on MPs, ministers and PM. It will not have jurisdiction over officers. The officers and politicians do not indulge in corruption separately. In any case of corruption, there is always an involvement of both of them. So according to government’s proposal, every case would need to be investigated by both CVC and Lokpal. So now, in each case, CVC will look into the role of bureaucrats while Lokpal will look into the role of politicians. Obviously the case records will be with one agency and the way government functions it will not share its records with the other agency. It is also possible that in the same case the two agencies arrive at completely opposite conclusions. Therefore it appears to be a sure way of killing any case.
Lokpal will consist of three members, all of them being retired judges. There is no reason why the choice should be restricted to judiciary. By creating so many post retirement posts for judges, the government will make the retiring judges vulnerable to government influences just before retirement as is already happening in the case of retiring bureaucrats. The retiring judges, in the hope of getting post retirement employment would do the bidding of the government in their last few years.
The selection committee consists of Vice President, PM, Leaders of both houses, Leaders of opposition in both houses, Law Minister and Home minister. Barring Vice President, all of them are politicians whose corruption Lokpal is supposed to investigate. So there is a direct conflict of interest. Also selection committee is heavily loaded in favor of the ruling party. Effectively ruling party will make the final selections. And obviously ruling party will never appoint strong and effective Lokpal.
Lokpal will not have powers to investigate any case against PM, which deals with foreign affairs, security and defence. This means that corruption in defence deals will be out of any scrutiny whatsoever. It will become impossible to investigate into any Bofors in future.
Therefore, the draft Lokpal ordinance is eyewash, a sham. It is sad that despite so much of embarrassment caused to UPA due to so many scams, UPA is still making a fool of the people in the form of this draft ordinance.

(Proposed to be passed as an ordinance by the Central government)
UPA government has been under constant attack due to exposure of one scam after the other on the issue of corruption. In order to salvage its image, the government proposes to set up an institution of Lokpal to check corruption at high places. However the remedy seems to be worse than the disease. Rather than strengthening anti corruption systems, this bill if passed, will end up weakening whatever exists in the name of anti corruption today.
The principal objections to government’s proposal are as follows:
Lokpal will not have any power to either initiate action suo motu in any case or even receive complaints of corruption from general public. The general public will make complaints to the speaker of Lok Sabha or chairperson of Rajya Sabha. Only those complaints forwarded by Speaker of Lok Sabha/ Chairperson of Rajya Sabha to Lokpal would be investigated by Lokpal. This not only severely restricts the functioning of Lokpal, it also provides a tool in the hands of the ruling party to have only those cases referred to Lokpal which pertain to political opponents (since speaker is always from the ruling party). It will also provide a tool in the hands of the ruling party to protect its own politicians.
Lokpal has been proposed to be an advisory body. Lokpal, after enquiry in any case, will forward its report to the competent authority. The competent authority will have final powers to decide whether to take action on Lokpal’s report or not. In the case of cabinet ministers, the competent authority is Prime Minister. In the case of PM and MPs the competent authority is Lok Sabha or Rajya Sabha, as the case may be. In the coalition era when the government of the day depends upon the support of its political partners, it will be impossible for the PM to act against any of his cabinet ministers on the basis of Lokpal’s report. For instance, if there were such a Lokpal today and if Lokpal made a recommendation to the PM to prosecute A. Raja, obviously the PM will not have the political courage to initiate prosecution against A. Raja. Likewise, if Lokpal made a report against the PM or any MP of the ruling party, will the house ever pass a resolution to prosecute the PM or the ruling party MP? Obviously, they will never do that.
The bill is legally unsound. Lokpal has not been given police powers. Therefore Lokpal cannot register an FIR. Therefore all the enquiries conducted by Lokpal will tantamount to “preliminary enquiries”. Even if the report of Lokpal is accepted, who will file the chargesheet in the court? Who will initiate prosecution? Who will appoint the prosecution lawyer? The entire bill is silent on that.
The bill does not say what will be the role of CBI after this bill. Can CBI and Lokpal investigate the same case or CBI will lose its powers to investigate politicians? If the latter is true, then this bill is meant to completely insulate politicians from any investigations whatsoever which are possible today through CBI.
There is a strong punishment for “frivolous” complaints. If any complaint is found to be false and frivolous, Lokpal will have the power to send the complainant to jail through summary trial but if the complaint were found to be true, the Lokpal will not have the power to send the corrupt politicians to jail! So the bill appears to be meant to browbeat, threaten and discourage those fighting against corruption.
Lokpal will have jurisdiction only on MPs, ministers and PM. It will not have jurisdiction over officers. The officers and politicians do not indulge in corruption separately. In any case of corruption, there is always an involvement of both of them. So according to government’s proposal, every case would need to be investigated by both CVC and Lokpal. So now, in each case, CVC will look into the role of bureaucrats while Lokpal will look into the role of politicians. Obviously the case records will be with one agency and the way government functions it will not share its records with the other agency. It is also possible that in the same case the two agencies arrive at completely opposite conclusions. Therefore it appears to be a sure way of killing any case.
Lokpal will consist of three members, all of them being retired judges. There is no reason why the choice should be restricted to judiciary. By creating so many post retirement posts for judges, the government will make the retiring judges vulnerable to government influences just before retirement as is already happening in the case of retiring bureaucrats. The retiring judges, in the hope of getting post retirement employment would do the bidding of the government in their last few years.
The selection committee consists of Vice President, PM, Leaders of both houses, Leaders of opposition in both houses, Law Minister and Home minister. Barring Vice President, all of them are politicians whose corruption Lokpal is supposed to investigate. So there is a direct conflict of interest. Also selection committee is heavily loaded in favor of the ruling party. Effectively ruling party will make the final selections. And obviously ruling party will never appoint strong and effective Lokpal.
Lokpal will not have powers to investigate any case against PM, which deals with foreign affairs, security and defence. This means that corruption in defence deals will be out of any scrutiny whatsoever. It will become impossible to investigate into any Bofors in future.
Therefore, the draft Lokpal ordinance is eyewash, a sham. It is sad that despite so much of embarrassment caused to UPA due to so many scams, UPA is still making a fool of the people in the form of this draft ordinance.

Why Jan Lokpal Bill is necessary
No politician or senior officer ever goes to jail despite huge evidence because Anti Corruption Branch (ACB) and CBI directly come under the government. Before starting investigation or initiating prosecution in any case, they have to take permission from the same bosses, against whom the case has to be investigated.
Lokpal at centre and Lokayukta at state level will be independent bodies. ACB and CBI will be merged into these bodies. They will have power to initiate investigations and prosecution against any officer or politician without needing anyoneⳠpermission. Investigation should be completed within 1 year and trial to get over in next 1 year. Within two years, the corrupt should go to jail.
No corrupt officer is dismissed from the job because Central Vigilance Commission, which is supposed to dismiss corrupt officers, is only an advisory body. Whenever it advises government to dismiss any senior corrupt officer, its advice is never implemented.
Lokpal and Lokayukta will have complete powers to order dismissal of a corrupt officer. CVC and all departmental vigilance will be merged into Lokpal and state vigilance will be merged into Lokayukta.
No action is taken against corrupt judges because permission is required from the Chief Justice of India to even register an FIR against corrupt judges.
Lokpal & Lokayukta shall have powers to investigate and prosecute any judge without needing anyoneⳠpermission.
Nowhere to go - People expose corruption but no action is taken on their complaints.
Lokpal & Lokayukta will have to enquire into and hear every complaint.
There is so much corruption within CBI and vigilance departments. Their functioning is so secret that it encourages corruption within these agencies.
All investigations in Lokpal & Lokayukta shall be transparent. After completion of investigation, all case records shall be open to public. Complaint against any staff of Lokpal & Lokayukta shall be enquired and punishment announced within two months.
Weak and corrupt people are appointed as heads of anti-corruption agencies.
Politicians will have absolutely no say in selections of Chairperson and members of Lokpal & Lokayukta. Selections will take place through a transparent and public participatory process.
Citizens face harassment in government offices. Sometimes they are forced to pay bribes. One can only complaint to senior officers. No action is taken on complaints because senior officers also get their cut.
Lokpal & Lokayukta will get public grievances resolved in time bound manner, impose a penalty of Rs 250 per day of delay to be deducted from the salary of guilty officer and award that amount as compensation to the aggrieved citizen.
Nothing in law to recover ill gotten wealth. A corrupt person can come out of jail and enjoy that money.
Loss caused to the government due to corruption will be recovered from all accused.
Small punishment for corruption- Punishment for corruption is minimum 6 months and maximum 7 years.
Enhanced punishment - The punishment would be minimum 5 years and maximum of life imprisonment.
A few Thieves and corrupt politicians sitting in Parliament have been putting hurdles in passing of Lokpal bill for last forty years and they are enjoying the fruits of power for their self and for their kith and kin. They ignore public who voted them to power. That is why now People of India led by Anna has come forward with a Lokpal bill drafted by them.
Government says that it cannot accept the draft of common men or civil society members because it is against the spirit of the Parliamentary democracy. They plead that the government draft has been referred to Standing Committee of the Parliament. Who are the members of the committee is also to be seen: person like Lalu, Amar Singh, Singhwi cannot do justice to Lokpal Bill
A few Thieves and Corrupt persons sitting in Parliament and who have been consistently earning and accumulating ill earned money and becoming richer and richer cannot be expected to pass a stern and effective Lokpal Bill. They have been applying their cleverness rather to postpone the bill for last 40 years
Now when under pressure of public agitation they have submitted the lokpal bill before Parliament, they have rather introduced provisions in their Bill to punish to those who complain against corrupt politicians and corrupt officers.
They have been consistently and willfully using “democracy” and “Secularism” as a tool and as a gun to shut the mouth of weeping, tortured and aggrieved public and shot the person, party and society who raise voice against the corrupt politicians. They have been consistently trying to puncture the movement of Anna as they did Ramdeo Baba’s movement against Black Money.
These clever politicians ( government flatterers ) fired at peaceful demonstrators at Ramlila Ground on 4th June in midnight where Mr. Ramdeo was sitting in fast to lead a movement to bring back black money .These clever politicians tried their level best to trap and torture Ramdeo , Bal Krishna Acharya , Anna and their supporters on flimsy ground… These cleaver politicians tried their level best to disallow Anna’s fast and left no stone unturned to prevent Anna and his followers raising voice against Government.
Government talks of Standing Committee, parliamentary democracy and adequate time to pass the bill. Government has lost credibility because they talked, discussed and debated various provision of proposed Lokpal bill along with members of Civil society and drafted a joint bill but while presenting the bill in Parliament, they completely ignored the ideas and views of Civil Society members.Government showed by action that they do not value draft prepared by civil society members and on the contrary they did their best to ridicule members of Civil society, to malign them and to threten them to discard their Jan lokpal bill or face the consequences as Ramdeo Baba faced.
Prime Minister Manmohan Singh says that in such a short span of time ( 10 days )as suggested by Anna Team, such a vital bill as Lokpal Bill cannot be passed by Parliament. I wish to mention here that this Parliament which is being used as a tool to hide the malicious intention of the government was never used during last seven years of UPA rule even to discuss the important bills like Finance Bill or any other bill. Parliament passed the bill pertaining to rise in their salary and perks in a day or two. Indira Gandhi Changed the basic structure of the Constitution by 42nd Amendment bill without any discussion in Parliament. Hundreds of bills are passed every year without any debate and discussion.

April6, 2009 The Economic Times: As India prepares to elect a new Parliament, a latest study shows that only 173 MPs in the 14th Lok Sabha actually spoke on legislative issues while the House passed nearly 40 per cent of the bills with less than one hour of debate.
Parliament is used for mutual mug slinging but not in constructive discussion. If there is a will, there is a way. Government has not exhibited their will to pass the strong Lokpal Bill. Their actions and activities clearly indicate that the government is determined to crush the movement of Anna and postpone the making of bill as long as possible.
But, here I wish to warn the government that this time people of India have awaken from their deep slumber and they will now ensure that their will of strong Lokpal bill is fulfilled by hook or by crook.
It is a bitter truth that government never understand the demands made by common men or an organized union until their peacefully placed demand is followed by agitation and violent agitation.
People of India know it very well that Government realize the gravity of the genuine demands only when some private and public properties are burnt , some innocent men are sacrificed and so on.
This government does not try to understand the sentiments of common men but try to divide them by hook or by crook. The issue is how to eliminate corrupt people from the system AND NOT who are THE POLITICAL PARTIES SUPPORTING Anna.
It is only when the Parliament has failed to pass the desired bill for last 40 years , need of the hour is to leave all works aside and work day and night to discuss and debate Jan Lok Pal bill and pass it in the Parliament to exhibit their effectiveness in practice.
Government should without any delay shed their ego and reconcile with the situation and do justice with public demands.

Parliament is made to represent the views of common men , not that of elected leaders . Elected leaders are supposed to read the pulse of common men and give value to views of civil society members. No rule or law should pose a hurdle in passing of a strong Lokpal Bill in 10 days if government is determined to pass the bill from core of their heart. They can continue debate 24 hours in Parliament for all the residual 9 or 10 days to give respect to public sentiments and Pass Lokpal Bill as agreed upon by consensus in Parliament, The purpose is to pass a effective legislation to create a fear complex in the minds of evil doers and prevent stop officers and politicians adopting corrupt practice for their self interest. It is not prudent and desirable that the government waste time in unnecessary discussions on non issues.It may be Lokpal or Jan lokpal or a mixture of the two . People of India want to get rid of corrupt people and for this purpose they are wholeheartedly behind Anna and Ramdeo.
I request leaders of Congress Party not to allow the situation Created by followers of Anna and Ramdeo going beyond their control and precipitate a situation like Tiananmen Square of China

Support Anna Team Now or Never
Anna has toled that leaders of Congress Party has betrayed Anna Team on Jan Lokpal Bill and on saction of place for fast scheduled to commence from 16th of this month.Government will continue to betray because it knows very well that opposition parties are divided, votes are divided and hence their victory in election in certain. As long as Anna do not get full fledged and unconditional support from opposition parties, the success of Anna's movement will undoubtedly be time consuming and the team of Anna Hazare will have to face tortures as Ramdeo Baba faced in recent past.
I had suggested on this forum and on many other forums that Ramdeo and Anna and their team should try to take the support of opposition parties on the issue of price rise, corruption and terrorism & naxalism to oust the most corrupt party from power.
I once again reiterate that support of opposition parties is unavoidable to precipitate situation like that created by Jai Prakash Narayan in 1974. After all India believes in Parliamentary democracy and there is no immediate threat to majority possessed by UPA in Parliament despite all stories of Corruption. It is only when elections are ordered voters will get an opportunity to teach a lesson to dictatorship of Congress Party led UPA’s . ”Chor upar Sinachori “ type policy has become the habit of ruling Congress Party only because they do not see any threat to their power in near future and for this they diplomatically tease the party BJP on communal and pseudo secularism.
The moment they realize that BJP is immediate threat to their survival they will immediately try to add Anna team into their fold .
When Indira Gandhi lost election petition filed by Raj Narayan in Allahabad court she clamped emergency in the country and lall prominent leaders of opposition parties were arrested early in the next morning . Excesses were committed during emergency and people were forced to surrender before dictatorship of rulers. After 20 months all leaders of all opposition parties realized that their unity was very much necessary to oust Dictator Indira Gandhi.
Time has once again come and need of the hour is that leaders of all opposition parties extend their whole hearted support to Anna and Ramdeo. Otherwise days are not far when they would face the same music as they faced during emergency. Ramdeo was tortured, Bal Krishna was tortured like anything but tax evaders like Hasan Ali has been released. Government brutally lathi charged BJP demonstrators in Delhi when they were shouting against corrupt leaders Shiela Dikchit.
If Anna Team also fails like Ramdeo Baba I think it will the greatest blow to fight against corruption and the consequence will be unprecedented rise in arbitrary rule of Congress Party. Price rise, corruption, black money and terror activities will rise by leaps and bounds and government will never act against evil doers.
It is desirable that prominent youth leaders, students of all colleges, and all social activites come together, extend voluntary support to Anna team . NOW or Never. It is the time to strengthen and empower Anna Team as much as possible to teach a lesson to shameless team of Congress Party leaders who are committing blunder after blunder, scam after scam and still threatening to peaceful activists.
I therefore request Anna Team to give enough value to leaders of opposition parties who are ready to support them. They should not fear Congress Party who plead that Anna is backed by RSS and BJP. It is very much necessary that a national party support a national movement for its grand success.

If Anna Team also fails like Ramdeo Baba I think it will the greatest blow to fight against corruption and the consequence will be unprecedented rise in arbitrary rule of Congress Party. Price rise, corruption, black money and terror activities will rise by leaps and bounds and government will never act against evil doers.
It is desirable that prominent youth leaders, students of all colleges, and all social activites come together, extend voluntary support to Anna team . NOW or Never. It is the time to strengthen and empower Anna Team as much as possible to teach a lesson to shameless team of Congress Party leaders who are committing blunder after blunder, scam after scam and still threatening to peaceful activists.
I therefore request Anna Team to give enough value to leaders of opposition parties who are ready to support them. They should not fear Congress Party who plead that Anna is backed by RSS and BJP. It is very much necessary that a national party support a national movement for its grand success.
